When she and her little guy moved up to Georgia she gave me a call one day and told me that she had to do a search for garage doors in Alpharetta recently. I asked her why and she said that for “some reason” they wouldn’t go up and down anymore. I wondered if perhaps her “little guy” (now around 9 years old) had something to do with this also?

Ruling Against Wal-Mart Upheld in Colorado

In Denver, Colorado the State Supreme Court has upheld a previous ruling regarding Walmart and a truck delivery driver injured on the job. It was originally declared that the truck driver was entitled to compensation in the amount of approximately $10 million after a combination of ice and grease caused her to slip and fall at a northern Colorado store.

The victim in the case, 41-year-old truck driver Holly Averyt, who resides in Cheyenne, Wyo. Experienced significant injury from the fall. To date, she has had three surgeries on her spine. As a result she lost her truck and can no longer work due to her physical condition.

In the original court case her lawyers provided documents from the city which demonstrated that grease build up produced by the Walmart deli, was not properly contained. The grease was supposed to be trapped in a device that prevents it from entering the sewers. In their defense, Walmart denied that there was any grease spill at their Greeley store.

Back in November of 2010 a jury ruled in Averyt’s favor, granting her $15 million. However, Walmart quickly filed an appeal, believing Averyt’s slip and fall lawyers did not fully disclose all documents. They were granted a new trial by the lower courts, who felt the compensation was “excessive” and the jury was attempting to punish the corporation.

The matter reached the State Supreme court this past Monday, who dismissed the order for a new trial. They felt the documents did not need to be disclosed and the jury did not show any unwarranted prejudice. They did however, reduce the amount awarded to Averyt by $5 million.
